Please read these terms & conditions carefully before committing to any 1LIFE product or service. You should understand that by committing to any of the 1LIFE products or services, you agree to be bound by these terms & conditions.

By purchasing/committing to 1LIFE products/services, you warrant that you are at least 18 years old. 

PERSONAL INFORMATION

All personal information you provide 1LIFE or that is obtained through delivering 1LIFE products and services will be handled by my 1LIFE team. The personal information you provide will be used to customise programming and to provide offers and information on products and services to you. The information you provide is only available to 1LIFE and will not be shared with other third parties. You have the right to inspect the information held about you. If you have any questions or concerns regarding your personal information or wish for 1LIFE to delete or correct the information held about you, please contact Dana at 1lifehumanperformance@gmail.com

**Please note 1LIFE reserve the right to disclose your personally identifiable information only in the exception when it is required by law and/or when we believe that disclosure is necessary to protect our rights and/or comply with a judicial proceeding, court order, or legal process served on our website/products/services.

PAYMENT

All products/services remain 1LIFE property until full payment is made. 

For online services, once 1LIFE receives payment, program development/process will commence and clients will receive their programs within 7 days. The price applicable is that set at the date on which you place your order. Payment methods and service commencement for direct contact services (PT, 1-on-1, semi-private training) can be discussed and agreed upon between 1LIFE and the client as they see fit.

All transfers through www.1lifehumanperformance.com.au (unless specifically stated by 1LIFE) are handled and transacted through third party dedicated gateways. Card information is not stored by 1LIFE. Please read the terms & conditions for the payment gateway in relation to your transactions as they are responsible for the transactions made.

ADDITIONAL INFORMATION

1LIFE reserves the right to amend any information, including but not limited to prices, technical specifications, terms of purchase and product offerings without prior notice. To ensure individual programming, numbers are limited for all products and services. In the event of when a product/service becomes full/sold out 1LIFE has the right to cancel an order/program and refund any amount paid in the best way 1LIFE sees fit. 1LIFE shall also notify the customer of equivalent replacement products or services if available.

RETURN POLICY

1LIFE does not allow returns or exchanges for any purchases. In the event of illness or circumstances that prevent you from being able to engage in a service/product you have purchased, 1LIFE may (completely at 1LIFE digression) allow you to place a temporary hold on your program/service until you are able to recommence. If you believe this applies to you, please contact Dana directly at 1lifehumanperformance@gmail.com to discuss. Please note full payment for services are required for any and all 1LIFE products/services.

FORCE MAJEURE

Events outside 1LIFE control, which is not reasonably foreseeable, shall be considered force majeure, meaning that 1LIFE is released from 1LIFE obligations to fulfil contractual agreements. Example of such events are government action or omission, new or amended legislation, conflict, embargo, fire or flood, sabotage, accident, war, natural disasters, strikes or lack of delivery from suppliers. The force majeure also includes government decisions that affect the market negatively and products, for example, restrictions, warnings, ban, etc.

WAIVER & RELEASE


Because physical exercise and strength training can be strenuous and subject to risk of serious injury, 1LIFE urge you to obtain a physical examination from a doctor before using any exercise equipment or participating in any exercise activity, 1LIFE product/service. You agree that by participating in 1LIFE programs and engaging in physical exercise or training activities that you are in good physical condition and do not suffer from any known disability or condition which would prevent or limit your participation in exercise, and you do so entirely at your own risk.

Any recommendation for changes in diet including the use of supplements are entirely your responsibility and you should consult a physician prior to undergoing any dietary or food supplement changes. You agree that you are voluntarily participating in 1LIFE programs and assume all risks of injury, illness, or death.

You acknowledge that you have carefully read this “waiver and release” and fully understand that it is a release of liability. You expressly agree to release and discharge 1LIFE from any and all claims or causes of action and you agree to voluntarily give up or waive any right that you may otherwise have to bring a legal action against 1LIFE and its employees for personal injury or property damage.

To the extent that statute or case law does not prohibit releases for negligence, this release is also for negligence.

If any portion of this release from liability shall be deemed by a Court of competent jurisdiction to be invalid, then the remainder of this release from liability shall remain in full force and effect and the offending provision or provisions severed here from.
